General Terms and Conditions of ADA Swiss GmbH

Art. 1 Scope

These General Terms and Conditions (GTC) apply to all services provided by ADA Swiss GmbH.

Art. 2 Duties of Umzugscenter AG

ADA Swiss GmbH is obliged to execute accepted orders/online purchases in accordance with the contract.

Art. 3 Obligations of the customer

The customer is obliged to provide information to the best of his knowledge and belief. In the case of missing or incorrect information, any additional costs will be charged to the customer, e.g. in the case of incorrect square meters, wrong number of rooms or different locations (cities).

Art. 4 Prices

For online bookings or acceptance of offers you agree with the prices including or excluding VAT.

Art. 6 Payment

Payments for online bookings can be made in cash, by invoice, in installments, by credit card, postcard and Paypal. In the case of orders or acceptance of offers, payments can be made on site in cash, by invoice or in installments.

Art. 7 Insurance/Public liability insurance

The all-risk insurance covers all damage (not only transport damage) without a deductible! AXA Winterthur Policy No. 15.324.591. Included in the price is a company / liability insurance of CHF 5 million. This insurance covers damage to third parties.

Art. 8 Transport insurance and carrier liability insurance

The all-risk insurance covers all damage (not only transport damage) without a deductible! Zurich Policy No. 15.631.776. A carrier's liability insurance over CHF 100'000.00 per trip is included in the price, but VAT must be declared. In the case of underinsurance, compensation may be reduced. This insurance covers the fair value of the moving goods in the event of damage proven to have been caused by gross negligence on the part of our personnel.

Art. 9 Disclaimer of liability

The ADA Swiss GmbH is only liable for damages which have been proven to be caused by negligence of its personnel. The liability of ADA Swiss GmbH begins with the acceptance of the goods and ends with the unloading at the place of destination. Excluded from the liability are damages to plants, malfunctions of electronic devices which have no external damage, as well as loss of cash, securities, coins, jewellery and similar valuables.

Art. 10 Report of damage

Damage that is externally recognizable must be reported immediately after the move, noted on the report and objected to within five days. Damage that is not externally visible must also be claimed within five working days. Complaints must be made in writing and must include the following: Damage report, possibly with photos, purchase invoice, proof of value and quotation for the repair costs. After the expiry of this deadline, no complaints or objections can be taken into account.

Art. 11 Order / cancellation

Should the service date change after the online booking, this must be notified in writing at least ten calendar days in advance and confirmed by our side. The customer has the right to reschedule a transport in progress against full compensation for the damage caused to the carrier. Any rescission by the client must be made in writing. In case of cancellation within 10 calendar days before the scheduled order date, no costs will be charged. The previous payment will be refunded. If the client withdraws from the contract within 48 hours of the planned move, 80% of the amount stated in the offer shall be owed in the sense of a lump-sum payment for expenses, efforts and activities. If the carrier proves a larger damage, this is also to be compensated.

Art. 12 Breaks

Two breaks, 15 minutes each, shall be borne by the client. The lunch break is not charged as working time.

Art. 13 Miscellaneous

ADA Swiss GmbH  reserves the right to amend these GTC at any time. Changes will be communicated to the customer in a suitable manner, in particular by corresponding publications on the internet pages of the company ADA Swiss GmbH.

Art. 14 Jurisdiction and applicable law

Any disputes arising from this contract must be assessed in accordance with Swiss law. The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship shall be the headquarters of ADA Swiss GmbH.
